Welcome to Quickdisha, Kerala's premier free classifieds platform. These Terms and Conditions ("Terms") govern your access to and use of our website and services. Please read them carefully.

By accessing or using Quickdisha.com, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our platform.

1. Acceptance of Terms

By creating an account, posting listings, or using any feature of Quickdisha, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

1.2 Eligibility

You must be at least 18 years old to use Quickdisha. By using our platform, you confirm that you meet this age requirement and have the legal capacity to enter into these Terms.

1.3 Updates to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through a prominent notice on our homepage for 30 days. Your continued use of Quickdisha after changes are posted constitutes acceptance of the updated Terms.

2. Description of Services

2.1 Platform Overview

Quickdisha is an online classifieds platform that enables users in Kerala, India to:

Post advertisements for products and services
Browse and search listings
Connect with buyers and sellers
Communicate regarding transactions

2.2 Categories

Our platform supports various categories including, but not limited to:

2.3 Platform Role

Quickdisha acts solely as a facilitator connecting buyers and sellers. We are not a party to any transaction and do not:

Buy, sell, or take ownership of any listed items
Process payments or handle money transfers
Verify the accuracy or legality of listings
Guarantee the quality or condition of products/services

3. User Accounts and Registration

3.1 Account Creation

To post listings on Quickdisha, you must create an account by providing:

Valid email address
Active mobile number
WhatsApp number (recommended)
Location within Kerala, India

3.2 Account Responsibility

You are responsible for:

Maintaining the confidentiality of your login credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access
Ensuring all information you provide is accurate and up-to-date

3.3 Account Security

Do not share your password with others. Quickdisha will never ask for your password via email or phone. You agree to notify us immediately at info@quickdisha.com if you suspect any unauthorized use of your account.

4. Posting Listings

4.1 Content Requirements

When posting listings, you must:

Provide accurate, complete, and truthful information
Use appropriate categories for your listings
Include clear, honest descriptions and genuine photos
Specify your correct location within Kerala
Provide valid contact information (email, phone, WhatsApp)

4.2 Posting Limits

You may post the same item in a maximum of (2) categories
Duplicate or spam listings will be removed
We may impose limits on the number or frequency of posts at our discretion

4.3 Listing Duration

Listings remain active for a specified period (typically 30-90 days depending on category). You may renew, edit, or delete your listings at any time through your account.

5. Prohibited Content and Activities

5.1 Prohibited Content

You may not post content that:

Legal Violations:

Advertises illegal goods, services, or activities under Indian law
Infringes on intellectual property rights (copyrights, trademarks, patents)
Contains false, misleading, or deceptive information
Violates any applicable regulations or laws

Harmful Content:

Is abusive, threatening, defamatory, or harassing
Contains hate speech or discriminatory content based on race, religion, caste, gender, nationality, or any other protected characteristic
Includes pornographic, sexually explicit, or obscene material
Depicts or promotes violence or harm to others
Contains personal information of others without consent

Technical Threats:

Contains viruses, malware, trojans, or other harmful code
Attempts to gain unauthorized access to our systems
Disrupts or interferes with platform functionality

5.2 Prohibited Activities

You may not:

Impersonate any person or entity
Post spam, chain letters, pyramid schemes, or unsolicited advertisements
Harvest or collect user information without consent
Use automated systems (bots, scrapers) to access or post on Quickdisha without permission
Contact users who have requested not to be contacted
Engage in fraudulent activities or scams
Post the same listing multiple times (beyond the two-category limit)
Manipulate reviews or ratings
Interfere with other users' ability to use the platform

5.3 Enforcement

Quickdisha reserves the right to:

Remove any content that violates these Terms without notice
Suspend or terminate accounts that violate these Terms
Report illegal activities to law enforcement authorities
Take legal action against users who cause harm to our platform or community

6. User Conduct and Responsibilities

6.1 Safe Trading Practices

When engaging in transactions, we strongly recommend:

Meet in public places during daylight hours
Inspect items thoroughly before making payment
Never send money to sellers without verifying the item
Use secure payment methods and avoid cash when possible
Trust your instincts – if something feels wrong, walk away
Report suspicious activity to us immediately

6.2 Personal Information

Exercise caution when sharing personal information. Once you share information in listings or messages, Quickdisha cannot control how it is used by others.

6.3 Due Diligence

You are solely responsible for:

Verifying the identity and legitimacy of other users
Assessing the quality, legality, and authenticity of items
Negotiating terms and prices
Resolving disputes with other users
Any legal or financial consequences of your transactions

6.4 Communication

Be respectful and professional in all communications
Respond promptly to inquiries about your listings
Do not engage in harassment or abusive behavior
Report violations to us through proper channels

7. Intellectual Property Rights

7.1 Quickdisha's Rights

All content on Quickdisha, including but not limited to design, layout, text, graphics, logos, and software, is owned by or licensed to Quickdisha and protected by Indian and international intellectual property laws.

You may not:

Copy, reproduce, modify, or distribute any part of the platform
Create derivative works based on Quickdisha
Reverse engineer, decompile, or disassemble any software
Use our trademarks or branding without written permission

7.2 User Content

By posting content on Quickdisha, you:

Retain ownership of your content
Grant Quickdisha a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content on our platform
Confirm you have the right to post the content
Agree that we may use your content for promotional purposes

7.3 Copyright Infringement

9. Disclaimers and Warranties

QUICKDISHA IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

9.2 User Interactions

We do not guarantee:

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKDISHA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:

10.1 Types of Damages

Direct, indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Personal injury or property damage
Damages resulting from unauthorized access to your account
Costs of obtaining substitute services

10.2 Situations

This limitation applies regardless of the cause of action, whether based on:

10.3 Maximum Liability

If, notwithstanding the foregoing, Quickdisha is found liable, our total liability shall not exceed ₹1,000 (One Thousand Indian Rupees) or the amount you paid us (if any) in the past 12 months, whichever is less.

11. Indemnification

You agree to defend, indemnify, and hold harmless Quickdisha and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

This obligation survives the termination of your account or these Terms.

13. Termination

13.1 Termination by You

13.3 Effect of Termination

Upon termination:

Your right to use Quickdisha immediately ceases
We may delete your content and account information
You must cease all use of the platform
Sections of these Terms that by their nature should survive (liability, indemnification, dispute resolution) remain in effect

We are not liable for any consequences of termination.

14. Dispute Resolution

14.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

14.3 Arbitration

Any dispute arising from these Terms or your use of Quickdisha that cannot be resolved informally shall be settled by binding arbitration under the Information Technology Act, 2000 and Information Technology Rules, 2021.

The arbitration shall be conducted in Kerala, India, in English language. The arbitrator's award shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

14.4 Class Action Waiver

You agree that disputes must be brought on an individual basis only, and not as a plaintiff or class member in any class or representative action.

14.5 Jurisdiction

For matters not subject to arbitration, you agree to submit to the exclusive jurisdiction of the courts in Kerala, India.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Quickdisha regarding the use of our platform.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

15.5 No Agency

No agency, partnership, joint venture, or employment relationship is created between you and Quickdisha through these Terms.

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.
